HC orders FIR against Rahul Gandhi, CBI probe likely

The Lucknow bench of the Allahabad High Court on Friday directed that an FIR be registered against Rahul Gandhi and ordered that the matter be handed over to the Central Bureau of Investigation for investigation.
The order was passed by Justice Subhash Vidyarthi while hearing a petition filed by Karnataka BJP worker S. Vignesh Shishir, who alleged that Rahul Gandhi had acquired British citizenship.
Earlier, on January 28, 2026, the MP-MLA Court had dismissed the petition, noting that no concrete evidence had been presented and that no higher court had issued directions in the matter. However, the High Court set aside that order, stating that the magistrate was not required to assess the truthfulness of the allegations at that stage.
During the hearing, the court asked the Foreigners Division of the Home Ministry to submit all relevant records, which were subsequently placed before the bench.
The petitioner claimed to have submitted documents suggesting that Rahul Gandhi was listed as a voter in the United Kingdom. The plea seeks action under multiple laws, including the Passport Act, provisions of the IPC, the Official Secrets Act, and the Foreigners Act, alleging that the issue involves serious questions of citizenship and national security.
The case was originally filed in the Special MP-MLA Court in Rae Bareli but was later transferred to Lucknow by the High Court in December 2025. After the Lucknow court dismissed the plea, the petitioner moved the High Court, which has now ordered the registration of an FIR.
Notably, a similar petition was dismissed by the Supreme Court of India in 2019, with then Chief Justice Ranjan Gogoi stating that the claims lacked merit.
Rahul Gandhi is also facing multiple cases in Uttar Pradesh, including defamation proceedings in Sultanpur and Hathras, as well as a separate case in Lucknow related to remarks on Vinayak Damodar Savarkar. His Lok Sabha membership had earlier been restored in 2023 after the Supreme Court stayed his conviction in the Modi surname case.
