HC Setback for Tripura Govt Over Minor’s Prolonged Custody

Tripura High Court has directed authorities to release a minor girl from Gandachhara in Dhalai district and restore her custody to her parents after she allegedly remained in institutional care for nearly four months.

The direction was issued during the hearing of a habeas corpus petition filed by the girl’s father, who had approached the High Court seeking the return of his daughter. Senior advocate Purushottam Roy Barman, appearing for the minor, said the court ordered that the girl be taken home and handed over to her parents.

The case has also raised questions about the circumstances under which the minor was separated from her family and kept in a child care facility for such a prolonged period.

According to the latest report on the proceedings, the High Court has sought a response from the Tripura government regarding the allegations surrounding the child’s custody.

Minor From Gandachhara Taken Into Institutional Care

The girl, a resident of Gandachhara in Dhalai district, was reportedly taken into institutional custody in May.

According to the submissions made in court, the authorities became involved after concerns were raised about a possible attempt to arrange the minor’s marriage. The child was subsequently placed under the supervision of the child welfare authorities.

Her father later approached the concerned administrative authorities seeking the release of his daughter. According to her counsel, those efforts did not result in her immediate return to the family, leading him to move the High Court.

Father Files Habeas Corpus Petition

The father subsequently filed a habeas corpus petition before the Tripura High Court.

A habeas corpus proceeding allows the court to examine the legality of a person's detention or custody and, where appropriate, order that person to be brought before the court or released.

During the proceedings, the petitioner's side questioned the legal basis for keeping the minor away from her parents for such an extended period.

The state's response to the allegations has now been sought by the court. The High Court has directed the government to submit an affidavit addressing the issues raised in the petition.

Court Directs Immediate Return to Parents

During the latest hearing, the division bench directed that the minor be released from the child care facility in Abhaynagar, Agartala, and returned to her family.

The order provides immediate relief to the girl's parents, who had been seeking her release through legal and administrative channels.

The lawyer representing the minor argued that the state authorities had not adequately justified the prolonged separation of the child from her parents.

Questions Over Prolonged Custody

The proceedings have also brought the functioning of child protection authorities under judicial scrutiny.

The petitioner's side has questioned whether the prescribed legal procedures were properly followed while keeping the girl in institutional care.

The High Court has sought a formal response from the state government before examining the wider issues raised by the petition.

The precise findings on the legality of the custody and the responsibility of individual officials will depend on the court's further consideration of the matter.

Compensation Issue May Come Before High Court

The minor's counsel has also indicated that the family may seek compensation for the prolonged separation of the child from her parents.

The argument is that the girl remained away from her family environment and was deprived of normal parental care and companionship during the period in question.

The court is expected to examine these issues in subsequent proceedings along with the circumstances that led to the minor being placed in institutional care.

Next Hearing Expected in October

The habeas corpus case is expected to come up again before the Tripura High Court in the coming weeks. The next proceedings are likely to focus on the government's explanation, the circumstances surrounding the child's custody and the questions raised regarding the actions of the authorities.

The case could therefore become significant for scrutiny of child protection procedures, parental custody and the safeguards applicable when a minor is placed in institutional care.

Why This Case Matters

The Gandachhara case highlights the balance authorities must maintain between protecting minors from potential harm and respecting the legal and familial rights of children and parents.

The High Court's intervention means the circumstances surrounding the girl's prolonged stay in institutional care will now receive judicial examination. The state government's affidavit and subsequent court proceedings are expected to provide greater clarity on the decisions taken by the authorities.

The Tripura High Court has previously dealt with habeas corpus matters involving children and parental custody, including cases concerning the relationship between child welfare and parental care.
