Supreme Court Sets Aside Gauhati High Court Verdict in Assam Foreigners Cases, Orders Fresh Hearing for 27 Citizenship Appeals

In a significant judgment concerning citizenship disputes, the Supreme Court (sci) on Monday quashed the 's decision that had upheld the declaration of 27 Assam residents as foreigners. The apex court ruled that a person's nationality cannot be determined without ensuring a fair, transparent and legally sound procedure.

A Bench comprising Justices Vikram Nath and Sandeep Mehta observed that questions relating to citizenship involve constitutional rights and must be examined with utmost care. The court consequently remanded all 27 matters to the Foreigners' Tribunal for fresh adjudication.

Supreme Court Clarifies It Has Not Granted Citizenship

The apex court made it clear that its order should not be interpreted as recognising the appellants as Indian citizens.

According to the judgment, the Supreme Court has neither verified nor accepted the documents, evidence or claims submitted by the appellants. Instead, the responsibility of examining those materials now rests with the Foreigners' Tribunal, which will decide each case independently after a complete hearing.

The Bench emphasised that sending the matters back for reconsideration is intended only to ensure that such a serious determination is reached through a lawful, impartial and comprehensive process.

Tribunal Directed to Conduct Fresh Proceedings

The Supreme Court instructed the Foreigners' Tribunal to rehear every case from the beginning without being influenced by either its previous findings or the observations recorded by the Gauhati High Court.

The Bench further clarified that all parties must receive a fair opportunity to present documentary evidence before any final conclusion regarding citizenship is reached.

Section 9 of the Foreigners Act to Continue

The court also reaffirmed the applicability of Section 9 of the Foreigners Act, 1946.

Under this provision, the legal burden of proving Indian citizenship remains on the individual whose nationality has been questioned. Therefore, every appellant will be required to establish citizenship by producing valid documents and other supporting evidence before the Tribunal.

Why the Gauhati High Court Rejected the Earlier Challenge

The 27 individuals had originally been declared foreigners by the Foreigners' Tribunal. Their challenge before the Gauhati High Court was dismissed.

The High Court observed that the petitioners approached the court nearly 23 years after the Tribunal's orders. It further noted that despite receiving notices, none of the petitioners appeared before the Tribunal or produced documents supporting their claim of Indian citizenship. Consequently, the Tribunal proceeded to declare them foreigners.

Understanding Section 9 of the Foreigners Act, 1946

Ordinarily, the party making an allegation bears the responsibility of proving it before a court of law.

However, Section 9 of the Foreigners Act creates an exception. Whenever an individual's nationality is questioned before a Foreigners' Tribunal, the responsibility shifts to that person to prove Indian citizenship through reliable documentary evidence. The government is not required to establish that the individual is a foreign national.

This legal provision continues to play a central role in citizenship-related proceedings across Assam and other parts of the country.
